Mountaintop
Terms of Use
Version 1.0 · Drafted October 6, 2026 · Effective date to be set on first production publication.
1. Agreement
These Terms govern your use of the Mountaintop application at mountaintopps.app (the "Service"), provided by Mountaintop Property Software LLC ("Mountaintop", "we", "us"), 7026 Corporate Way, Suite 109, Dayton, Ohio 45459. By using the Service you agree to these Terms. If you use it on behalf of an organization, you confirm you are authorized to do so.
Where an organization has a separate agreement or order with Mountaintop (a "Customer Agreement"), that agreement also applies.
2. Access by invitation
The Service is available only to people invited by an organization’s authorized users, or set up by Mountaintop. It is currently a limited pilot in the United States only. Your organization controls your role and access and may change or end them.
3. Your account
Keep your sign-in details confidential and use a strong password. Tell us promptly at hello@mountaintopps.com if you believe your account has been misused. You are responsible for activity under your account, except where caused by our failure to meet these Terms.
4. Acceptable use
- Do not use the Service unlawfully, or to harass, threaten or harm anyone.
- Do not impersonate anyone or misrepresent your relationship to an organization or property.
- Do not access or attempt to access accounts, records or organizations you are not authorized to use.
- Do not upload malicious code, harmful files or content you have no right to share.
- Do not interfere with, probe, overload or bypass the Service’s security or operation.
- Do not collect, use or disclose another organization’s or person’s information in ways the Service and its permissions do not allow.
5. Organizations’ and users’ responsibilities
Organizations are responsible for who they invite, the roles and permissions they grant, the accuracy of information they enter, and having any notices, consents or rights needed to put information about others into the Service.
6. Your content
You keep ownership of the content you submit. You give Mountaintop a limited licence to host, process, reproduce, transmit and display it only as reasonably necessary to operate, secure, back up and support the Service.
The Service keeps a history of submitted records, so your content may remain part of your organization’s records as described in the Privacy Policy and any Customer Agreement.
7. Privacy
Our Privacy Policy explains how we handle information and forms part of these Terms.
8. Not an emergency service
Mountaintop is not an emergency service. It is not monitored for emergencies and does not send or dispatch help. If anyone is in immediate danger, or there is a fire, gas leak, flooding or other emergency, call 911 or your local emergency number. Marking an Issue as an urgent concern does not summon help.
9. Availability
We work to keep the Service available, but we do not promise it will be uninterrupted, timely or error-free. It may change, be maintained, or be temporarily unavailable.
10. Third-party providers
The Service relies on the third-party providers listed in the Privacy Policy. We are not responsible for services we do not control, except as stated in a Customer Agreement.
11. Suspension and termination
We may suspend or end access under a Customer Agreement, where required by law, to protect the security of the Service or others, or for misuse including breach of these Terms.
An organization may end a user’s access at any time. Historical records may remain after access ends where legitimately required.
12. Fees
Any fees are governed by the applicable Customer Agreement or order. The Service does not collect rent, process payments or perform accounting.
13. Intellectual property
The Service, including its software, design and branding, belongs to Mountaintop or its licensors and is protected by law. These Terms give you no rights in it other than to use the Service as permitted.
14. Disclaimers
Except as stated in a Customer Agreement, the Service is provided "as is" and "as available", without warranties of any kind, to the extent the law permits. The Service records and communicates about property condition. It does not provide inspection certification, legal, safety or professional advice.
15. Limitation of liability
Pending legal review. No limitation-of-liability terms are included in this draft.
16. Indemnity
Draft for legal review. If you or your organization breach these Terms or misuse the Service, you will be responsible for resulting third-party claims against Mountaintop, as and to the extent provided by applicable law and any Customer Agreement.
17. Governing law
These Terms are governed by the laws of the State of Ohio, United States.
18. Changes
We may update these Terms. When we make material changes, we will post the updated Terms with a new effective date. Where appropriate, we will also tell you through the Service or by email.
